These general terms & conditions are designed to govern the contractual relationship between the company and the Magnetic Arts client defined below as "user" of the website www.magnetic arts.pt.

These general terms & conditions apply in an exclusive between society Magnetic Arts and anyone who makes a purchase or visit the website www.magneticarts.pt.

These general terms & conditions may be subject to change without notice, according to the conditions in force on the website the date of registration of order.  The mere fact that they place an order implies acceptance without reservation, the general terms & conditions.

The Magnetic Arts grant a limited license to access and use of the website. The user is not in any way authorized to download, copy or modify, in whole or in part, the website without the express written permission and the Magnetic Arts.

Products
The essential characteristics of products and services offered to sale are presented on the website, including models, colors, patterns and sizes available.

The Magnetic Arts alert to the fact that there may be subtle differences in the way of viewing the colors of the models between equipment due to the use of various systems such as color CMYK and RGB, the characteristics and calibration of equipment, is not responsible for any not correct interpretations of them by the user.  You can, whenever it so wishes, request, by mail, information on the reference of the colors used in models.

The products proposed for sale are shown on the website, to date, and may be amended or replaced without notice.  Despite a product be discontinued, ensures itself, if applicable, the supply of the product as the order.

Application
The company Magnetic Arts is offering its customers a simple means to customize and decorate on a number of magnetic objects, including household appliances.

Order & Services
The orders are carried out through the Internet. It will not be accepted any cancellation of the order after sending the same.  The customer will receive, via email, the confirmation of the application.

The Magnetic Arts reserves the right to cancel or refuse any order from a client with whomthere is a dispute regarding the payment of a previous order or any other nature.

You must ensure that the images transmitted to the Magnetic Arts respect the laws in force, including the laws on pornography, violence, pedophilia, as well as intellectual property laws.

The Magnetic Arts reserves the right not to print photos or images possessing a nature violent, racist, and pornographic or pedophile, even those not covered by the law.  The Magnetic Arts has the right to report any breach of criminal law.

If applicable, the user to place an order for Magnetic Arts, represent and warrant be owner or have the necessary rights on the content of broadcast media and that the support is not offensive to others (notably that it is not defamatory).

Accepts compensate the Magnetic Arts of any damage, loss, expenditure or honorary that this could have to pay a third due to the spread on the website or the printing of images that have been reported, provided that the action of others against Magnetic Arts was motivated by content that we announced or were the basis or origin of it.

Availability of orders
The orders are always fulfilled by the availability of our stock.  In case of collapse of stocks you will be informed, by mail, the deadline for production and delivery and, if desired, cancel your order at no additional cost.

Price
The posted prices are in Euros and include VAT.
Shipping costs upon request.  In each order will include its cost.
The Magnetic Arts reserves the right to change prices at any time without notice.

Delivery
The order will be delivered within 15 days, by mail or other means of dispatch that will define Magnetic Arts, the address as the order.
 

The delivery period mentioned is only indicative and may possibly be changed. The Magnetic Arts cannot be held responsible for the consequences resulting from a delay in delivery or a loss of volumes by the services of mail or a carrier.

You should check at the time of delivery, the proper status of packages and their contents, and in case of non-compliance, should determine their reservations detail and confirm them with the Magnetic Arts, no later than five days from the date of delivery by registered mail.

When and if necessary, the cost of reference of the orders is the responsibility of the client.

The payment of an order can be made as follows:

If there is room for reimbursement, the user is repaid in the same mode of payment used to settle its order.

Retention of title
The goods remain the property of Magnetic Arts until its full payment by the user. The transfer of ownership of products to the customer is carried out at full payment of the price.
 

However, during the period between the delivery and transfer of ownership, the risk of loss, theft or destruction shall be borne by the user.

The lack of compliance by the client, its obligations to pay for any reason, gives the Magnetic Arts the right to demand the immediate restitution of the goods delivered the risk of customer.

Intellectual property
The entire contents of the website www.magneticarts.pt (text, illustrations, and computer code) are the property of Magnetic Arts, its co-contractors or partners. Any partial or total reproduction of the content by any means and on any type of support is prohibited without the consent of Magnetic Arts.

The images transmitted by an order of height remain the property of the user.

The user states hold, as the laws in force, all intellectual property rights for which transmits images to Magnetic Arts in the manner prescribed by these Terms of Sales.  The user undertakes to respect the rights of copyright under the law in force in their country.

In any case, the Magnetic Arts would be held responsible for violation by a user of rights held by third parties and perpetrated the proportion of the activities of the latter on the website.

Confidentiality
The personal data provided by the user are not released to third parties.
 

In making an order for Magnetic Arts, undertakes to provide information correct. Personal data which we communicate is essential to the manufacturing, sending and billing.  The lack of filling these fields triggering the cancellation of its order.

The user's personal data are used to send the goods ordered, to inform the new offerings of Magnetic Arts or to contact in case of any problem with his order.

The Magnetic Arts is the only holder of information relating to them in accordance with the law "Information Technology and Freedoms."  It has a permanent right of access and correction on any data that relate to each other, in accordance with the laws in force.  Only Magnetic Arts and its contractual partners may send you information in operations promotional precise and punctual.
 
Promotional codes
The codes are only valid for products specified in our website. A promotional code corresponding to an offer should only be used once. It is not refundable.  The promotional codes are not accumulated on the same order.

Right of withdrawal - Satisfied or refunded
To exercise the right of withdrawal, you must resubmit a registered letter, within fourteen days counted from the receipt of the order, all the material received.

This material must be new, complete and the products must be returned to us in the original packaging along with the invoice / receipt.  Products returned incomplete, damaged or used by the customer cannot be accepted.

This right of withdrawal is exercised without penalty, except for the costs of transmission. 

Assuming the use of the right of withdrawal, you may ask, or the repayment of amounts paid, either to exchange the product.  In the case of an exchange, the shipment of products to receive a refund will be made on account of the user.

Applicable law - Competent jurisdiction
The website has been prepared in accordance with the laws in force in Portugal.
Any dispute which may arise between a user and the Magnetic Arts will be submitted to the entities (jurisdictions) under the competent Court of Appeal of Lisbon.
